Promotional Competition Rules – Terms and Conditions
MAY 2022 – KOTEX® Menstrual Hygiene Day 2023 SOCIAL MEDIA COMPETITION
1. The “Promotor” is Kimberly-Clark of South Africa, 2nd Floor Office Building 2, 2929 William Nicol Drive, Bryanston, Johannesburg, 2021 (“Kimberly-Clark”).
2. The “Promotion” means the Kotex® Menstrual Hygiene Day Social Media competition.
3. The Promotion shall commence from the 26th of May 2023 to the 29th of May 2023
4. “Participant” means a person who enters the Promotion
5. “Prize” means a thing given as a reward to the winner of a competition
Five (5) x Takealot vouchers to the value of Five Hundred Rands (R500) each
The Prize cannot be exchanged for monetary value or any other consideration. Unless otherwise agreed in writing prizes are not transferable.
6. The Promotion is open to any natural person that lives in South Africa other than a person that is a director, member, partner, employee or agent of, or consultant to Kimberly-Clark, its merchandisers, advertising, PR agencies, or any other person who directly or indirectly controls or is controlled by Kimberly-Clark or a supplier of goods or services associated with the supply of goods and services in connection with this campaign and all such persons’ immediate families.
7. Participation in this Promotion constitutes acceptance of the rules, terms & conditions.
8. Requirements:
8.1. In order to be eligible for Participation in this Competition:
8.1.1. Participants must not be under the age of 18 (eighteen) and reside in South Africa to be considered. Proof of South African ID will be requested to verify winners.
8.1.2. Participants must adhere to the terms and conditions that apply to this Competition.
8.2. How to enter:
8.2.1. Participants will need to:
a) Follow the Kotex Instagram page
b) Share the picture in their Instagram story of them wearing the Kotex® Menstrual Hygiene Day bracelet
c) Tag Kotex_sa and use all our hashtags in the story post ( #MHDay #SheCan #Kotex)
8.2.2. The Participant releases the social media platform from any liability in any respect.
8.3. Detailed mechanic:
8.3.1. Entries received through any medium other than sharing a story post on Instagram shall not be considered.
8.3.2. Entries are limited to ten (10) per Participant.
8.3.3. Participants will stand a chance to win
8.3.4. Winners will be determined by a random selection system.
8.3.5. Should entry into this Promotion be contingent on the Participant entering any website, social media page, or application, the Participant hereby acknowledges that any costs associated with the required internet connection shall not constitute a cost of entering into this Campaign and which cost shall be borne solely by the Participant.
8.4. Prizes and Award Terms:
8.4.1. Five (5) winners will be selected and announced on the 31st of May 2023, and no negotiations will be entered into as the decision is final.
8.4.2. In the event that any of the prize winners cannot be successfully contacted within 24 hours of the final decision or is unable, for any reason whatsoever, to accept the prize, a replacement winner will be randomly drawn from the remaining qualifying Participants in the draw in accordance with the same process and procedures as applicable to the original draw.
8.4.3. Five (5) winners will need to supply their contact details and current delivery address.
8.4.4. All personal information relating to the prize delivery will be disposed of in line with the Protection of Personal Information Act (POPIA).
8.4.5. The Promotor reserves the right to make media announcements and/or publications of the name and photographs of the winners, provided that any winner may elect to expressly / in writing decline this. The Promoter also reserves the right to carry out audits in respect of any winner of the promotional incentive in order to verify their eligibility. Any Winner may be requested, without any compensation whatsoever, to attend the draw and announcement of the Winner; participate in the Promoter’s publicity campaigns, and/or allow their names and likenesses to be used by the Promoter for promotional purposes. The Winner is, however, entitled to decline such a request.
9. Use of personal information:
9.1. By participating in this Promotion, all Participants consent to the use of their personal data by the Promotor for the purposes of the administration of this Promotion and to which the Participant has consented.
10. General:
10.1. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Kimberly-Clark, Kimberly-Clark reserves the right to the extent permitted by law (a) to disqualify any Participant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
10.2. Kimberly-Clark has the right to terminate the “Prizes” immediately and without notice. In the event of such termination, all Participants agree to waive any rights that they may have in terms of this and acknowledge that they will have no recourse against Kimberly-Clark or a supplier of goods or services in connection with this promotion.
10.3. To the fullest extent permitted by applicable law (but not otherwise) Kimberly-Clark, sponsors assume no responsibility and are not liable for:- (i) the accuracy or otherwise of the prize description or illustration, (ii) the non-availability, loss, interception, or interference with, late receipt or damage of or to any prize, coupon or notification or other communication, (iii) any representation, warranty, condition or guarantee in respect of a prize.
10.4. The Participant unconditionally and irrevocably indemnifies and holds harmless Kimberly-Clark, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents, or consultants against all and any losses, claims, proceeding, actions, damages, (direct, consequential or otherwise) liability, demands, expenses, legal costs (on an attorney and own client basis) howsoever arising out of, based upon, or in connection with (directly or indirectly) the Participant’s participation in the Promotion and the Prizes.
